"Can a school suspend a 1st grader when the behavior is a manifestation of their disability? Behavior was throwing pencils, chairs, although no one was seriously injured. They cited California education code 48900(a)(1) 48900(f) and a violation of district board policy- causing a disruption on campus.
Also I requested a BIP last school year when I requested my son be evaluated for special education and the school psychologist did not complete one. Behaviors have been ongoing resulting in suspension. Now they are doing a reactive BIP vs the preventative BIP I requested last year. A BIP would have likely prevented the incident resulting in his suspension.
Last but not least, after my sons behaviors in his class an email was sent out to his whole class. While his name was not mentioned anyone could easily identify him. The intentions were twofold and we feel they alienated him even more by not protecting very personal information and incidents and tried instead to welcome him back saying he was embarrassed and lonely and that if other students felt necessary they could welcome him back or ignore him. Is this a breach in privacy?
